Terms of Service

1. Acceptance of Terms

By accessing or using the Mapalyze platform, website, and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

Mapalyze provides a field data collection platform that enables users to create forms, capture data with GPS coordinates and photos, work offline, and export data in standard formats. The Service includes web, mobile, and API access as described in your subscription plan.

3. Accounts and Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Data Ownership

You retain all rights to the data you collect, create, and store using Mapalyze. We do not claim ownership of your field data, photos, form templates, or any content you create. You may export your data at any time in standard open formats.

5. Subscription and Payment

Paid features require a subscription. Pricing is per user as listed on our Pricing page. Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing with 30 days' notice.

6. Free Trial

New accounts receive a 14-day free trial with access to all features. No credit card is required. At the end of the trial, you must select a paid plan to continue using the Service. If no plan is selected, your account is paused but your data is preserved.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' data
• Interfere with or disrupt the Service's infrastructure
• Reverse engineer, decompile, or disassemble the Service
• Resell or redistribute the Service without authorization

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Offline functionality allows continued data collection during service interruptions. We will provide reasonable notice of planned maintenance.

9. Limitation of Liability

To the maximum extent permitted by law, Mapalyze shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amounts paid by you in the twelve months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. Upon termination, you may export your data for 90 days. After 90 days, your data will be permanently deleted. We reserve the right to suspend accounts that violate these Terms.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use constitutes acceptance of updated Terms.

12. Indemnification

You agree to indemnify and hold harmless Mapalyze, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

13. User Submissions & Feedback

When you submit feedback, feature requests, bug reports, testimonials, or other content through our platform or website forms, you grant Mapalyze a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such submissions for the purposes of improving our service, marketing, and promotional activities. This includes the right to use your name, company name, and submission content in marketing materials, case studies, and on our website. Submissions may be edited for clarity and length.

You may request removal of your submission from marketing materials at any time by contacting info@mapalyze.com. Personal data within submissions is handled according to our Privacy Policy.
